This Privacy Policy is intended to inform you about how we treat PersonalInformation that we collect, hold, use and disclose about you. We may alsocollect non-personal information for any purpose. If you do not agree to anypart of this Privacy Policy, then you should stop accessing our services,including our applications (“BMP Sports Service”)
BMP Sports collects, holds, uses and discloses Personal Information that youvoluntarily provide when applying or registering for a BMP Sports account. WSCmay combine the information you provide voluntarily with other WSC or thirdparties to enhance your user experience.
By using BMP Sports Services, you are entering into a binding agreement with usand are consenting to the use of your information as set out in this PrivacyPolicy. You unambiguously agree that we may collect, hold, use and discloseyour information in the manner described below and in accordance with the termsdescribed in this Privacy Policy.
We may allow our related entities, such as our subsidiaries, and theiremployees, to use and process your Personal Information in the same way and tothe same extent that we are permitted to under this Privacy Policy. Theserelated entities comply with the same obligations that we have to protect yourPersonal Information under this Privacy Policy.
WHAT CONSTITUTES:
“PERSONAL INFORMATION”?
Personal Information is any information (including but not limited tonumerical, alphabetical, graphic, photographic, sound, or any other type ofinformation concerning an individual) or opinion (whether fact or not) whicheither identifies you or from which your identity can reasonably be determined,including in conjunction with other information to which a third party has oris likely to have access to.
Personal Information can only relate to human beings, and information aboutcompanies and other legal entities is not covered by the provisions of thisPrivacy Policy.
WSC does not collect private and sensitive Personal Information. SensitivePersonal Information includes (but is not limited to) racial or ethnic origin,academic qualifications, political opinions, personal identification numbers,political views, religious beliefs or affiliations, philosophical beliefs,trade union membership, sexual orientation or practices, criminal records,health information or biometric information.
REGISTRATION AND USAGE DATA
When you register with, or download the BMP Sports Mobile Application and/orany other service or application of BMP Sports, BMP Sports may collect thefollowing information in its server logs:
a) information that you provide when applying or registering for access to the BMPSports Service which may include your username, password, name, date of birth,gender, email address, home or work address, telephone number, as well asdemographic information, such as your zip or postal code and country. BMPSports may also collect your IP-address during registration;
b) information that you voluntarily provide such as your telephone number,photographs, comments and posts, linked friends names and the like;
c) if you connect to the BMP Sports Service through your Facebook account, youauthorise us to collect your linked authentication details including but notlimited to your username, name, email address and any other PersonalInformation available on or through your Facebook account including gender,country and town, profile pictures, photographs, and comments;
d) technical details of your computer and device system (including but notlimited to the type and version of your browser, operating system, displayresolution, JavaScript-settings and other items;
e) when you use the Service on a mobile device, we may collect, hold, use anddisclose different types of information about your location, including generalinformation such as your IP address and zip or postal code, as well as morespecific advice such as your GPS-based location. If you access the BMP SportsService through a mobile device and you do not want your device to provide uswith location-tracking information, you can disable the GPS or otherlocation-tracking functions on your device, provided your device allows you todo this. See your device manufacturer’s instructions for further details;
f) referrer URL (the address of the site that has been accessed before);
g) URL’s visited at www.worldseriescricket.com;
h) hostname of your computer (IP address);
i) time and date of access; and
j) information about your interaction with the BMP Sports Service, includingsearches, your use of such search results, selections which you make, downloadsand streams that you initiate and/or complete, comments, reviews, yourresponses to advertisements, your interactions with persons who send youe-mails or other communications (the text of e-mails will not be processed),frequency with which you visit or use the BMP Sports Service, length of usage,transaction related information, customer service usage, and details, interestsand behaviour relating to transactions, products, services and activity inconnection to the BMP Sports Service.
We may also publish, disclose, and use information (other than PersonalInformation) for industry analysis, demographic profiling, marketing andadvertising, and other business purposes.
COOKIES
When you use the BMP Sports Service, our server may send small data files knownas ‘cookies’ and other similar technologies to your device. We may also allowour business partners to use their cookies and other tracking technologies onthe BMP Sports Service platform. When you revisit or re-use the BMP SportsService, the cookies allow the site to recognize your browser, making yourexperience on the BMP Sports Service more convenient and personal. The cookiesmay also store your preferences and other information that will allow us totailor and simplify your experience when using the BMP Sports Service.
For example, we may use cookies for the purposes of our own customer support,analytics, research, product development, fraud prevention, risk assessment,regulatory compliance, investigation, as well as to analyse how the BMP SportsService are used and accessed, or to target marketing and advertising torelevant demographics.
You have the option of changing your browser preferences to not allow cookiesor even request your permission to send cookies. However, some BMP Sportsfeatures may not function correctly without cookies enabled. Most of BMP Sports’sfeatures rely on the voluntary information you provide through your memberprofile, which you will have access to manage and update.
LINKED SERVICES
Please note that the BMP Sports Service may be co-branded and offered inconjunction with other websites and/or services provided by unrelated thirdparties, and/or linked social media accounts such as Facebook and Twitter. Ifyou register for (or use such a service), that other third party may alsoreceive Personal Information collected in conjunction with the co-brandedservice. Other partners (i.e. advertising clients advertising on BMP Sports, aswell as those who provide for advertising supported entertainment products andother internet sites and services accessible via www.worldseriescricket.com)may also collect data about you.
These parties have their own data protection guidelines, which are independentof this Privacy Policy. Further, if you integrate your BMP Sports account withthird party social media accounts, including Facebook, Twitter and the like, wemay also collect, hold, use and disclose the Personal Information as set outabove which you have made available either on or through your linked socialmedia account. To change, customise, or limit access to or sharing ofinformation collected from third party social media accounts, please visit youraccount settings on that service.
COMPETITIONS, PROMOTIONS OR SWEEPSTAKES
Additional information may also be collected if you choose to enter into anycompetitions, promotions or sweepstakes held in connection or through the BMPSports Service. That additional information may be combined with other accountinformation, and may be collected, held, used and disclosed as described inthis Privacy Policy.USE OF PERSONAL INFORMATIONYou expressly consent to BMPSports using the information we collect and hold, including your PersonalInformation, in the following ways:
a) to enable you to access and use the BMP Sports Service;
b) to deliver and fulfil the BMP Sports Service or carry out the transactionsyou have requested (including but not limited to downloads, streams, caching,purchases and resolution of issues which you encounter);
c) to provide, personalise and improve the BMP Sports Service in line with ourusers’ needs and to display content and targeted advertising that is customisedto their interests and preferences;
d) to ensure technical functioning of the BMP Sports Service and analyse youruse to the BMP Sports Service, including your interaction with applications,advertising, products and services that are made available, linked to oroffered by the BMP Sports Service;
e) to administer rewards, surveys, sweepstakes, contests, or other promotionalactivities or events sponsored or managed by BMP Sports or our partners;
f) to contact you directly about your use of the BMP Sports Service, and/oryour participation in rewards, surveys, sweepstakes, contests, or otherpromotional activities or events sponsored or managed by BMP Sports or ourpartners;
g) to comply with our legal obligations, resolve any disputes that we may havewith any of our users, and enforce our agreements with third parties;
h) to communicate with you about the BMP Sports Service such as servicenotices, reminders and administrative messages, push notifications, reminders,technical notices, updates, security alerts and information requested by you;and
i) to send you direct marketing, electronic direct marketing, and promotionalmessages and other information that may be of interest to you, includinginformation about BMP Sports or general promotions for partner campaigns, goodsand services. You may opt out of receiving these notifications andcorrespondence at any time by clicking on the “Unsubscribe” link at the bottomof each communication, or alternatively by contacting BMP Sports support.
BMP Sports has taken the necessary action to ensure that all personalinformation of Members is securely maintained. You may receive information,correspondence and push notifications from our partners and third partyorganisations. By using the BMP Sports Service, you are expressly agreeing to BMPSports acting in this manner.
PUSH NOTIFICATIONS
BMP Sports may send you push notifications about our content and playlists onthe BMP Sports Service.
You have the option of changing your preferences to not allow pushnotifications. See your device manufacturer’s instructions for further details.
SHARING INFORMATION
The BMP Sports Service can integrate with various social media programsincluding Facebook, Instagram, Twitter and the like. Much of the informationwhich you choose to be publicly available shall be available by default,including your username, profile picture, any friends or playlists you arefollowing, or those following you, your recent activity and any content youpost or upload.
If you connect to the BMP Sports Service or download the BMP Sports Applicationusing your Facebook account or other third party social media service, BMPSports may automatically share your recent activity within that linked thirdparty service, including any Content you have accessed, followed or commentedon. You acknowledge and agree that Facebook’s or other third parties use of anyinformation you post or which is collected from you is governed by theirprivacy policies and that BMP Sports’s use of that information is governed bythis Privacy Policy.
BMP Sports occasionally employs third parties to provide services on itsbehalf, such as handling the bandwidth and storage necessary to perform the BMPSports Services, or performing statistical analysis. The access of such partiesto your Personal Information will be limited to the data they need in order todeliver the service.
BMP Sports may also share information in order to obtain content from thirdparties, analyse usage patterns, provide demographic information, assist indesign of advertising campaigns and other similar uses that will facilitatethird party contacts in appropriate cases with parties selected by BMP Sports,as well as to prevent, investigate or take action regarding suspected fraud andother illegal activities, as well as situations involving potential threats tothe physical safety of any person and violations of BMP Sports’s Terms ofService.
We may access and/or disclose your Personal Information if we, in our solediscretion, deem it necessary to:
a) comply with applicable laws; or
b) respond to subpoenas, court orders, or legal process; or
c) to establish or exercise our legal rights or to defend ourselves againstlegal claims.
We may provide the information which we collect to our successors and assignsin the event that we transfer, sell or dispose of all or any portion of ourbusiness and the information is relevant to that business segment.
BMP Sports may also share your information to third parties in the followingsituations:
a) to respond to any relevant legal court order or subpoena, and/or in order tocomply with any applicable law;
b) to protect the safety of any person;
c) to enforce BMP Sports’s Terms of Service;
d) to prevent, investigate or address fraud, security or technical issues;
e) in the event of a merger, acquisition or sale of part or all of the BMPSports Group;
f) to advise our partners of the usage of the BMP Sports Service, in the formof non-personal statistics and data; and
g) if you expressly opt in to having your data shared.
You understand and agree that the privacy policies of any third party willgovern their use of the information that we share with them.
TRANSFER TO OTHER COUNTRIES
BMP Sports may collect, hold, use, disclose or process your information,including Personal Information, on servers located in a number of countries.Accordingly, BMP Sports may share your information with other related companiesfor the purpose of them carrying out any of the activities specified in thisPrivacy Policy. BMP Sports may also subcontract to or share your informationwith third parties located in countries, other than your home country. Pleasenote that laws vary from jurisdiction to jurisdiction, and so the privacy lawsapplicable to the places where your information is transferred or collected,held, used, disclosed or processed in, may be different from the privacy lawsapplicable to the place where you are a resident. BMP Sports will usereasonable endeavours to ensure a comparable standard of protection is accordedto personal data that may be transferred overseas. You expressly consent toyour information being used as set out in this section and Privacy Policy.
STORAGE OF INFORMATION
We will hold your Personal Information for the period necessary to fulfil thepurposes outlined in this Privacy Policy, unless a longer retention period isrequired or permitted by law, and in any event for as long as you continue touse the BMP Sports Service.
CAN YOU OBJECT TO GIVING YOUR PERSONAL INFORMATION?
Should you choose to use the BMP Sports Service, we will require your PersonalInformation so that we are able to provide the services.
CAN YOU ACCESS YOUR PERSONAL INFORMATION?
You may request access to your Personal Information at any time, and we willprovide access to your information. In order to respond to your request, we mayrequire the following information to be provided:
a) your name and address;
b) your contact telephone number(s); and
c) your BMP Sports username.This service is usually provided free of charge andwe ask that the request be made in writing. Should the information you requirebe held in our archives, there may be a small administration fee charged toassist with meeting this cost. Prior to acting upon your request we will adviseyou of any fees which may be payable.
We will act on all such requests as soon as reasonably possible on receipt ofthe request.
UPDATING YOUR PERSONAL INFORMATION
We will take steps to ensure that your Personal Information is accurate, up todate and complete, and to update information where we are advised of changes.
To ensure we can provide you with the best possible service, it is important toensure your information is accurate, up to date and complete. Should there beany change to your Personal Information, we ask that you update us as soon aspracticable. We will update your details upon receiving instructions from youto do so.
You may review, update, correct or delete the Personal Information on your BMPSports Account at any time. If you would like to correct your information orcancel your BMP Sports account entirely, you can do so by logging in to youraccount.
USE OF SERVICE BY CHILDREN
The BMP Sports Service is not intended for children under the age of 13. When avisitor indicates an age under 13, the registration process for the BMP SportsService cannot be completed, and no personally identifying information iscollected in conjunction with that attempted submission except that we retaine-mail addresses of such persons (and record of access attempts) for purposesof denying registration. Otherwise, we do not knowingly collect personallyidentifiable information from visitors under the age of 13. BMP Sportscollects, uses and discloses information on users aged 13-18 in the same manneras it does for adults. If you are under the age of 18, you must obtain yourparent’s permission before disclosing any information on the Service.
SECURITY
BMP Sports will protect Personal Information in its possession or under itscontrol by making reasonable security arrangements to prevent unauthorisedaccess, collection, use, disclosure, copying, modification, disposal or similarrisks.
BMP Sports works with secure data networks protected by both industry-standardfirewalls and passwords. We continuously implement and update security measuresin order to safeguard your Personal Information. We also limit access toPersonal Information to those BMP Sports employees (and those employees of ouraffiliates) that we believe reasonably need to come into contact with thatinformation to provide our products and services to you.
If a username and password is used to help to protect your account fromunauthorised access, you must keep such login data confidential and must notdisclose it or share it with anyone. We recommend that you select a unique andstrong password to prevent unauthorised access to your account. If you haveused a shared device, you must ensure that you sign out.
We work to protect the security of your information during transmission byusing secure sockets layer software, which encrypts information you input. BMPSports will endeavour to take all reasonable steps to protect your PersonalInformation, however no method of transmission over the Internet and no methodof storing electronic information can be 100% secure, and we do not guaranteethe security of user information at any time.
Any third party that processes data on behalf of BMP Sports shall, beforecommencing the processing of data, provide BMP Sports with appropriatecommitments and other adequate guarantees of the data security.
CHANGES TO THIS PRIVACY POLICY
BMP Sports reserves the right to change this Privacy Policy at any time, withor without notice to you, by posting an updated version. The amended PrivacyPolicy will apply to you whether or not we have given you specific notice ofany change. However, if we make changes which we believe are material, we willinform you of these changes. Your continued use of the BMP Sports Servicesthereafter constituted acceptance of those changes.
We will occasionally update this Privacy Policy to reflect user feedback, legalrequirements and changes in our services. We encourage you to review thisPrivacy Policy at regular intervals in order to be informed of how we arehandling your information.
INCONSISTENCIES
Where there are any translations of this Agreement and to the extent of anyinconsistency, the English version shall prevail.
